  • Trader: XLsuperstores B.V., trading under the name LaadkabelXL.
  • Customer: the natural person or legal entity that enters into an agreement with the trader.
  • Consumer: the customer who is a natural person and is not acting in the course of a profession or business.
  • Business customer: the customer who is acting in the course of a profession or business.
  • Distance contract: an agreement concluded via the online shop, by e-mail or by telephone, without the trader and the customer being physically present at the same time.
  • Withdrawal period: the period within which the consumer can exercise their right of withdrawal.
  • Right of withdrawal: the consumer's option to withdraw from the distance contract within the withdrawal period.
  • Durable medium: any means, such as e-mail, that allows information to be stored in a way that it can later be consulted unchanged.

Article 3 – Applicability

  1. These terms and conditions apply to every offer made by the trader and to every agreement concluded via www.laadkabelxl.nl or otherwise at a distance.
  2. Before the agreement is concluded, the trader makes these terms and conditions available via the website in a way that allows the customer to save and print them. On request, they will be sent free of charge.
  3. Deviations from these terms and conditions apply only if they have been agreed in writing. Deviations to the detriment of the consumer are not permitted.
  4. The customer's general terms and conditions do not apply.
  5. If any provision of these terms and conditions is null and void or voidable, the remaining provisions remain in force. The provision in question will be replaced by a provision that comes as close as possible to the intent of the original provision.

Article 4 – The offer

  1. The offer contains a description of the products that is as complete and accurate as possible, so that the customer can make a proper assessment. Images are a true representation; minor deviations in colour or design are possible.
  2. Obvious mistakes or errors in the offer, such as a clearly incorrect price, are not binding on the trader.
  3. An offer is valid while stocks last, unless stated otherwise. Products that are temporarily out of stock may be offered as a backorder; this will then be clearly stated with the product.
  4. The customer is responsible for choosing a product that is suitable for their vehicle and charging point. The trader will gladly provide advice on this upon request.

Article 5 – The agreement

  1. The agreement is concluded at the moment the customer accepts the offer by completing the order.
  2. The trader confirms receipt of the order immediately by e-mail. As long as this confirmation has not been sent, the customer may dissolve the agreement.
  3. The trader takes appropriate technical and organisational measures to secure the electronic transfer of data and the payment.
  4. The trader may refuse an order or attach conditions to it if there are justified reasons to do so, for example in the event of suspected fraud. The customer will be notified of this as soon as possible and any amounts already paid will be refunded.

Article 6 – Prices and payment

  1. All prices are in euros and include VAT. Any shipping costs are clearly stated before the order is completed.
  2. Prices are subject to change. For an order already placed, the price that applied at the time of ordering applies.
  3. Payment is made using the payment methods offered at checkout. In principle, orders are only shipped after receipt of payment.
  4. If a consumer does not pay on time, they will first receive a payment reminder with a period of 14 days. Only after that may the trader charge statutory interest and extrajudicial collection costs, within the limits of the law.

Article 7 – Delivery

  1. For products that are in stock: ordered on working days before 22:00, delivered tomorrow. This delivery time is a target and not a strict deadline.
  2. Products purchased as a backorder are shipped as soon as the new stock has arrived.
  3. The trader delivers within 30 days at the latest, unless a longer period has been agreed. If this is not possible, the customer will be notified and may dissolve the agreement free of charge. Any amounts already paid will then be refunded within 14 days.
  4. The risk of damage or loss passes to the consumer at the moment the product has been delivered to them or to a person designated by them.
  5. The customer ensures a correct delivery address. Additional costs resulting from an incorrect address or a parcel not collected in time may be charged, insofar as the law permits.

Article 8 – Right of withdrawal

  1. The consumer can withdraw from a distance contract during a withdrawal period of 14 days without giving any reason. The withdrawal period starts on the day after receipt of the product or, for an order delivered in several shipments, on the day after receipt of the last shipment.
  2. The consumer notifies the withdrawal within the withdrawal period via info@laadkabelxl.nl or using the withdrawal form.
  3. Within 14 days of the notification, the consumer returns the product, complete with all accessories supplied and, where possible, in the original packaging.
  4. During the withdrawal period, the consumer handles the product with care. They may only unpack and inspect the product as they would in a shop. The consumer is liable for any diminished value resulting from handling that goes beyond that.
  5. The direct costs of returning the product are borne by the consumer, unless the product was delivered incorrectly or defective.
  6. The trader refunds all payments made by the consumer, including the standard shipping costs, as soon as possible and at the latest within 14 days of the notification of withdrawal. The trader may withhold the refund until it has received the product or until the consumer demonstrates that they have returned it, whichever is earlier. The refund is made using the same payment method, unless agreed otherwise. Additional costs for a more expensive shipping method than standard shipping are not refunded.
  7. The right of withdrawal does not apply to products manufactured according to the consumer's specifications. The trader will state this before the agreement is concluded.

Article 9 – Conformity and warranty

  1. The trader guarantees that the products comply with the agreement, with the specifications stated in the offer and with the reasonable requirements of soundness and usability (statutory warranty).
  2. A defect that becomes apparent within one year of delivery is presumed to have existed at the time of delivery, unless the trader proves otherwise.
  3. If a product is not in conformity, the consumer is entitled to free repair or replacement and, if that is not possible or reasonable, to a price reduction or dissolution of the agreement.
  4. The statutory warranty does not apply to defects caused by normal wear and tear, incorrect or careless use, use contrary to the instructions for use, connection to an unsuitable installation, external causes such as dropping, being driven over or moisture, or repairs and modifications not carried out by or on behalf of the trader.
  5. The consumer reports a defect within two months of discovering it. The procedure is described on the Warranty page.

Article 10 – Complaints

  1. The customer submits complaints about the performance of the agreement to the trader, fully and clearly described, via info@laadkabelxl.nl or the complaint form.
  2. The trader responds to complaints within 14 days of receipt. If a complaint requires more time, the customer will receive an acknowledgement of receipt within that period and an indication of when they can expect a more detailed response.
  3. If the trader and the customer cannot resolve the matter together, the dispute may be submitted to the competent court.

Article 11 – Liability

  1. The trader's liability is limited to the amount the customer paid for the product concerned, unless the damage is the result of intent or deliberate recklessness on the part of the trader.
  2. The trader is not liable for damage resulting from incorrect use of the product, use contrary to the instructions for use or use with an unsuitable electrical installation.
  3. These limitations do not apply insofar as the law does not permit them with respect to consumers, including statutory product liability.

Article 12 – Business customers

  1. The statutory right of withdrawal does not apply to business customers. However, for regular purchases the trader offers business customers a return option of 14 days after receipt, under the same conditions as set out in Article 8, paragraphs 2 to 5.
  2. For business customers, a payment term of 14 days from the invoice date applies, unless agreed otherwise.
  3. Liability towards business customers is limited to the invoice amount of the product concerned. Liability for indirect damage, such as consequential damage, loss of profit and business interruption, is excluded.

Article 13 – Personal data

The trader processes personal data carefully and in accordance with the General Data Protection Regulation (GDPR). More information can be found in the privacy policy.

Article 14 – Applicable law

  1. Agreements between the trader and the customer are governed exclusively by Dutch law.
  2. If the consumer lives in another country, they retain the protection afforded to them by the mandatory provisions of the law of their country of residence.

Article 15 – Amendment of the terms and conditions

The trader may amend these terms and conditions. An agreement is always governed by the version that applied at the time of ordering.
